1 GENERAL
By registering for a course and paying the course fees participants accept the terms and conditions stated herein.
Eurovent Middle East (hereinafter referred to as EME) as provider of the HVACR Leadership Academy forms the contractual partner for participants enrolling in any of the courses offered under the HVACR Leadership Academy.
2 REGISTRATION AND PAYMENT
All participants need to duly register for courses through the means stated on EME’s website under the section where each course is described. Pre-registrations are indicating a participant’s interest in attending a course, but do not constitute the right to enroll. Only once a course fee is fully paid, the registration becomes binding for the course, date, and time the participant has registered for.
Course fees must be paid in full at the time of registration.
3 CANCELLATIONS, SUBSTITUTION, NO SHOWS, AND REFUNDS
3.1 Physical courses
Participants can cancel a course with full refund of the course fees up to 30 days prior to the original starting date. In case participants need to cancel their participation less than 30 days but more than 14 days before the original starting date, they can nominate a substitute or request full credit for their course fees to be used in a consecutive or alternate course.
In case of a cancellation less than 14 days prior, it is subject to EME if a substitution or credit is possible. Participants shall contact office@eurovent.me for information.
Participants not cancelling and not showing up to a course are foregoing their right for refund or credit of their paid course fees.
3.2 Online courses
EME does not offer credits or accept any substitutions for online courses. Refunds can be requested until 7 days prior to the start of an online course. Within less than 7 days, no refund or credit will be granted.
3.3 Fees and bank charges
EME does not impose fees for cancellation or refunds, but any bank charges and transaction fees from external payment and ticketing providers will have to be borne by the participant.
4 WARRANTY AND DISCLAIMER
EME ensures that all training courses are delivered diligently and in a professional manner consistent with industry standards. The training services will be performed as described in the individual course description. EME shall provide such trainers to present the training course as it deems fit and EME shall be entitled at any time to substitute any trainer with any other person who it deems suitably qualified to present the relevant course.
For online courses, EME utilises third party service providers and does not accept liability for any technical faults, flaws, or interruption in connectivity.
5 LIMITATION OF LIABILITY
5.1 EME reserves the right to cancel a course or re- schedule a course date at any time and for any reasons. EME shall endeavour to inform the participant as soon as possible of the cancellation or rescheduling, and in case of rescheduling, to offer a new course date reasonably convenient for participants. In case of cancellation, EME shall refund the course fee without undue delay. Such refund will be the only remedy available to the participant in case of cancellation by EME. EME will not compensate any other costs incurred by the participant (e.g. travel, accommodation).
5.2 EME does not accept responsibility for anyone acting as a result of information in, or views expressed within, its training courses and course materials. Opinions expressed are those of individual trainers and not necessarily those of EME. Participants should take professional advice when dealing with specific situations.
5.3 EME SHALL NOT BE LIABLE FOR ANY LOSS OF USE, LOST OR INACCURATE DATA, FAILURE OF SECURITY MECHANISMS, INTERRUPTION OF BUSINESS, COSTS OF DELAY OR ANY INDIRECT, SPECIAL, INCIDENTAL, RELIANCE OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS), REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) STRICT LIABILITY OR OTHERWISE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE.
6 INDEMNIFICATION
The participant agrees to defend, indemnify, and hold harmless EME and its directors, officers, and employees from and against any demands, damages or liabilities including reasonable attorney’s fees arising from a third-party claim that the participant caused bodily injury (including death) or damages to real or tangible property.
7 OWNERSHIP AND INTELLECTUAL PROPERTY RIGHTS
All course material is the intellectual property of EME and its partners, including the design, graphics and text of all printed materials and the video and audio of all webinars. No course material may be copied, reproduced, uploaded, posted, displayed or linked to in any way, in whole or in part, without EME‘s prior permission. Any such use is strictly prohibited and will constitute an infringement of EME’s intellectual property rights.
8 DISPUTE RESOLUTION: ARBITRATION
In the event of any controversy or claim arising out of or relating to these Terms & Conditions, the parties hereto shall consult and negotiate with each other and, recognising their mutual interests, attempt to reach a solution satisfactory to both parties. If the parties do not reach settlement within a period of 60 days, any unresolved controversy or claim arising out of or relating to these Terms & Conditions shall proceed to binding arbitration under the Rules of Arbitration of the International Chamber of Commerce. The language of the arbitration shall be English.
9 GOVERNING LAW, PLACE OF JURISDICTION
The governing law for this contract shall be the law of the UAE. Place of jurisdiction shall be Dubai.
